摘要:
为提高移民安置的总体效益,基于新型城镇化建设的背景以及农村宅基地制度改革的探索,在相关法律法规及政策梳理比较的基础上,引入动态博弈模型,并结合对泰东河工程移民安置实践的实证分析,探究水利工程移民影响到的宅基地权益及其保护路径。研究发现,水利工程移民工作对宅基地使用权造成直接影响,对宅基地发展权及移民参与权有间接影响; 移民权益保障需要公众广泛参与,但是政府与移民之间博弈的时间成本会影响移民安置工作的总体效益。应当在规划层面促进水利工程移民、新型城镇化建设及宅基地改革的协同,完善移民管理体系和公共参与机制,通过提高政府的治理能力和移民的参与能力降低博弈中的时间成本,提高总体效益。
Abstract:
In order to improve the overall benefits of resettlement, based on the background of the new urbanization construction and the exploration of rural homestead reform, based on a comparison of relevant laws, regulations and policies, a dynamic game model was introduced and combined with the resettlement of the Taidong River Project Practical empirical analysis, the homestead rights affected by water project resettlement and their protection paths were explored. The study found that the water conservancy project migration work had a direct impact on the homestead land use rights, and had an indirect impact on the homestead development rights and the right to participate in the migration; the protection of the rights and interests of the migrants required extensive public participation, but the time cost of the game between the government and the immigrants would affect the immigrants. The coordination of water conservancy project immigration, new-type urbanization construction, and homestead reform should be promoted at the planning level, and the immigration management system and public participation mechanism should be improved. The government's governance capacity and immigration participation capacity should be improved to reduce the time cost in the game and improve overall efficiency.
