摘要:
在水行政执法实践中,经常遇到违法主体合并与分立的情形,给行政违法主体认定造成困难,尤其是针对建筑物、构筑物方面的违法建设主体认定。从违法行为构成要素出发,参照民法、刑法及专业法律法规的相关规定,对水行政执法过程中违法主体的认定方法进行分析归纳,并以此为基础,通过案例分析,针对租赁及转租、产权转让、在建工程违法、共同违法等情形的主体认定进行分析,并进行了方法总结。
Abstract:
In the practice of water administrative law enforcement,the merger and separation of illegal subjects were often encountered,which caused difficulties to the identification of administrative illegal subjects,especially for the identification of illegal construction subjects in buildings and structures. Starting from the elements of illegal behavior,referring to relevant provisions of civil law,criminal law and professional laws and regulations,identification methods of illegal subjects in the process of water administrative law enforcement were analyzed and summarized. And on this basis,subject identification of leasing and sub-lease,transfer of property rights,illegal construction in progress,common illegal and other circumstances were analyzed and the methods were summarized through cases analysis.
